These Terms of Service ("Terms") govern your access to and use of the mobile applications and services ("Services") provided by Darth Panda Pty Ltd ("Darth Panda," "we," "us," or "our"), including Consistly and any other applications we may offer.
By downloading, installing, or using any of our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.
You must be at least 13 years old (or 16 in the European Economic Area) to use our Services. By using our Services, you represent that you meet this age requirement. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

By submitting User Content, you grant Darth Panda a non-exclusive, worldwide, royalty-free licence to use, reproduce, modify, and display your User Content solely for the purpose of operating, improving, and promoting the Services.
You are solely responsible for your User Content and the consequences of posting or sharing it. You represent that you have all rights necessary to submit your User Content and that it does not violate any third party's rights.
We reserve the right, but are not obligated, to remove or modify any User Content that we determine, in our sole discretion, violates these Terms or is otherwise harmful or inappropriate.
Certain Services include artificial intelligence features, such as AI coaching in Consistly. You acknowledge and agree that:
Our Services may offer subscription-based premium features ("Subscriptions"). Subscriptions are purchased through the Apple App Store or Google Play Store and are subject to the respective store's terms and conditions.
Subscription fees are charged to your Apple ID or Google account at the time of purchase. Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the end of the current period.
You may cancel your subscription at any time through your device's subscription management settings (Apple Settings or Google Play Store). Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.
Refund requests must be directed to the Apple App Store or Google Play Store, as they process all payments. We do not process refunds directly.
We may change subscription pricing at any time. Price changes will take effect at the start of the next billing period following the notice. Your continued use of the Services after a price change constitutes acceptance of the new pricing.
All rights, title, and interest in and to the Services, including but not limited to all software, text, images, graphics, logos, icons, and audio, are owned by Darth Panda or our licensors and are protected by Australian and international intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or brand features without our prior written consent.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Services will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy or completeness of any information provided through the Services, including AI-generated content.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DARTH PANDA AND ITS DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES.
Our total aggregate liability for all claims arising out of or relating to these Terms or the Services shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or AUD $100, whichever is greater.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable Australian Consumer Law.
You agree to indemnify and hold harmless Darth Panda and its directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the Services, your User Content, or your violation of these Terms.
We may suspend or terminate your access to the Services at any time, with or without cause, with or without notice. Upon termination, your right to use the Services ceases immediately. Sections of these Terms that by their nature should survive termination will survive.
You may terminate your account at any time by deleting your account through the app settings or by contacting us at .
We may revise these Terms from time to time. We will notify you of material changes by posting the updated Terms in our Apps and updating the "Last updated" date. Your continued use of the Services after any changes constitutes your acceptance of the revised Terms.
These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
